PLEASE NOTE: For European Orders, The AI STORE will no longer be IOSS registered from the 1st January 2023 and therefore EU customers will be subject to customs duties and import VAT for your country.

Definitions

In these conditions, unless the context requires otherwise: ‘Buyer’ means the person who buys or agrees to buy the goods from the Seller; ‘Conditions’ means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller; ‘Goods’ means the articles which the Buyer agrees to buy from the Seller; ‘Price’ means the price for the Goods excluding carriage, packing, and insurance; and 'Seller' means AI Store; ‘Standard Delivery Charge’ means the charge applicable to deliveries within mainland England, Wales and Scotland. ‘Product Description’ means the description of the Goods provided on the Sellers website. 

The Goods

The quantity and description of the Goods shall be as described in the Product Description. All dimensions are approximate and should any specific information (which is not within the Product Description) be required the Seller will endeavour to provide this on request. 

The multiples in which the Goods are sold are listed within the Product Descriptions. All prices listed however are per single item. 

Warranties and Liabilities

The Seller warrants that the Goods supplied will at the time of delivery correspond to the description given by the Seller. 

All other warranties, conditions or terms relating to fitness for purpose, quality or condition of the Goods, whether express or implied by statute or common law or otherwise are excluded to the fullest extent permitted by law. 

Placing an Order

When an order is placed, through any e-commerce website or portal, the Buyer is making an offer to buy goods. Once the goods have been selected and placed in the “basket” the Buyer can “checkout” through a secure payment site. 

Once the price and availability of the goods have been checked, the Seller will email the Buyer to confirm that the order has been received, accepted, and that a contract has been made between the parties. The Seller will not take payment from the Buyer until the Seller has accepted the order. 

In the unlikely event that the goods are no longer available, or that a pricing mistake, has been made, the Seller will advise the Buyer of this. and there will be no contract between the parties. 

By using this site, the Buyer indicates that they accept these terms of use and that they agree to abide by them. If they do not agree to these terms of use, they should refrain from using the site or purchasing goods from the Seller. 

All prices indicated are stated in GBP Pounds Sterling and may be subject to UK VAT and delivery costs. VAT and Delivery costs vary by destination. Billing and shipping addresses must match for orders to be processed. 

Customs and Import Charges Disclaimer

Shipments are made under INCOTERMS 2020 Free Carrier (FCA). i.e. The seller is responsible for delivery of goods to a named carrier. Responsibility for cost and risk then passes to the buyer. The AI STORE is UK VAT registered and this will be added at checkout for UK customers. BUT is no longer IOSS registered from 1st January 2023 so there will be customs duties and import VAT charges for EU countries . Outside of the UK, any customs or import duties that are levied once the package reaches the destination country, or additional charges for customs clearance, will have to be borne by the recipient (the Buyer): The Seller has no control over these charges and cannot predict what they might be. Since customs policies vary widely from country to country, the Buyer may want to contact their local customs office for further information. 

Delivery of the Goods

Once the order has been processed, the order will be dispatched by Royal Mail Standard Surface, Airmail or courier to the Buyer’s address. The Buyer shall make all arrangements to take delivery of the Goods whenever they are tendered for delivery. Please allow 7 to 12 business days for delivery. 

Cancellation

The Buyer can cancel their contract up to 14 days after their order is delivered. To do this they should email us or write to the Seller. The Buyer does not have to give any reason for cancellation. However, a brief explanation will help to improve the service offered to customers in the future.

Written Communications

Applicable laws require that some of the information or communications the Seller send to the Buyer should be in writing. When using the site, the Buyer accepts that communication with the Seller will be mainly electronic. The Seller will contact the Buyer by e-mail or provide them with information by posting notices on the website. For contractual purposes, the Buyer agrees to this electronic means of communication and they acknowledge that all contracts, notices, information and other communications that the Seller provides to the Buyer electronically comply with any legal requirement that such communications be in writing. This condition does not affect the Buyers statutory rights. 

Transfer of Rights and Obligations

The contract between the buyer and the Seller is binding. The Buyer may not transfer, assign, charge or otherwise dispose of a Contract, or any of their rights or obligations arising under it, without our prior written consent. 

The Seller may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of their rights or obligations arising under it, at any time during the term of the Contract. 

Events Outside our Control

The Seller will not be liable or responsible for any failure to perform, or delay in performance of, any of their obligations under a Contract that is caused by events outside their reasonable control (Force Majeure Event). A Force Majeure Event includes any act, event, non-happening, omission or accident beyond reasonable control and includes in particular (without limitation) the following: 

• Strikes, lock-outs or other industrial action.

• Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.

• Fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster.

• Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

• Impossibility of the use of public or private telecommunications networks.

• The acts, decrees, legislation, regulations or restrictions of any government.

The Sellers performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues and will have an extension of time for performance for the duration of that period. The Seller will use their reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which their obligations under the Contract may be performed despite the Force Majeure Event. 

Law and Jurisdiction

Contracts for the purchase of Products through the site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of England and Wales. 

Changes to these Terms

These terms were last changed on 24th February 2023. 

These terms apply to the Buyers order. The Seller reserves the right to change the terms and conditions at any time, therefore do not assume that the same terms will apply to future orders.
